ISDA’s Annual Legal Forum is the second iteration of this major legal conference that will spend a full day focusing on key current legal issues. The first part of the conference will consist of plenary panel sessions with senior panellists that will set up the key issues in their broader legal and regulatory context. One plenary session will contain a regulatory update on the key cross border initiatives, another will cover the impact of and considerations around Brexit, and the other the key issues and initiatives related to Benchmarks. The afternoon’s breakout sessions will go into more detail on individual topics, and participants will be able to select the topics that are of most interest to them.
The Trade Pop-Up Event: MiFID II Systemic Interalisers

The removal of broker crossing networks (BCNs) and their replacement with systematic internalisers (SIs) is one of the least-understood areas of MiFID II. With regulatory clarification expected imminently on what will be possible under the new SI regime, The TRADE will be holding a pop-up event in London in February 2017 to help the buy-side understand what this means for their business.
· How has the SI regime under MiFID II changed from MiFID I?
· What are the advantages and disadvantages of using an SI over a BCN?
· SIs under MiFID I have not been widely used, are the strictly inferior to other ways of trading?
· Do the transparency requirements for SIs prevent them being effective dark pools?
· Will the buy-side still receive the same support and liquidity as they do on BCNs?
· Can the SI regime help prevent issues with toxicity that have plagued some dark pools?

ISDA’s Derivatives Disputes: Litigating and arbitrating the ISDA Master Agreements

This conference discusses considerations for market participants in the derivatives markets concerning which dispute resolution mechanism to adopt. If arbitration is chosen, we will discuss how to use the ISDA Arbitration Guide and further drafting considerations beyond the issues covered by the Guide itself. If litigation is chosen, we will discuss various cases from domestic and international litigation involving sell-side and buy-side firms as well as some observations on expert witnesses and enforcement.
